WHEREAS

The Said Property is the absolute, lawful ownership and possession of the First Party.

The Purchaser (Second Party), being in need of a residential premises, approached the Vendor for purchase of the Said Property. After mutual negotiations, the total agreed sale consideration was finalized at Rs. ____________________/- (Rupees ______________________ only).

The First Party agreed that the price offered by the Purchaser is fair considering the market rate.

The Vendor hereby agrees to sell and the Purchaser agrees to purchase the Said Property for a total consideration of Rs. _________________________.

The Vendor declares that the Said Property is free from all encumbrances, claims, liens, mortgage, lease, charge, litigation or any third-party rights.

Therefore, this Sale Deed is executed on the following terms and conditions:


TERMS & CONDITIONS

  1. The First Party, being the rightful owner and possessor of the Said Property, hereby sells the Said Property to the Second Party for Rs. __________________________ which is fully paid and accepted by the First Party at the time of execution of this Sale Deed.
  2. The Second Party has paid the total sale consideration of Rs. __________________________ to the First Party as acknowledged in the receipt provided at the end of this Sale Deed.
  3. Upon receiving the full consideration amount, the First Party has transferred absolute ownership rights of the Said Property to the Second Party permanently. No dispute shall be raised by the First Party now or in future.
  4. The First Party has handed over vacant, peaceful, legal, and physical possession of the Said Property to the Second Party at the property site in the presence of witnesses. There is no dispute regarding possession.
  5. The Second Party shall be the absolute owner of the Said Property from today. If anyone objects to his ownership, the First Party shall resolve such objections or legal disputes at his own cost and compensate the Purchaser for any losses.
  6. Electricity and water connections presently registered under the Vendor’s name shall be transferred to the Purchaser. The Vendor shall sign necessary documents, NOCs, declarations & affidavits and remain present personally when required.
  7. Property tax / Grampanchayat tax records currently stand in the Vendor’s name. The vendor shall co-operate and remain present until mutation of the property in the name of the Purchaser is completed.
    Taxes, electricity bills and water bills till today shall be paid by the Vendor.
    Bills after the date of this Sale Deed shall be the responsibility of the Purchaser.
  8. Stamp duty, registration charges and advocate fees relating to this Sale Deed shall be paid by the Purchaser. The Vendor shall sign documents and remain present before Sub-Registrar without any charges.
  9. After full payment, the Purchaser shall have complete rights over the development and benefits of the Said Property, and the Vendor shall not demand any additional amount under any reason.
  10. The Vendor guarantees that the Said Property is his exclusive property. No family member, heir, relative or any other person has any right, claim, interest or share in it. The property is not mortgaged / gifted / leased / sold or under any agreement prior to this Sale. In case of any objection by any person in future, the Vendor shall clear such disputes at his own expense.
  11. The Purchaser shall have full rights to enjoy, use, lease, gift or sell the property without any restrictions. If any future objections arise regarding ownership or possession, the Vendor shall resolve them at his own cost and compensate for any loss caused to the Purchaser.

Both the parties have read, understood, accepted and voluntarily executed this Sale Deed in the presence of witnesses.
